Terms and Conditions

Reservations

As the guest in the cabin you are financially responsible for any damage done to the home during your stay. If you notice any damage or anything out of the ordinary, please contact us within 1 hour of your arrival at 909-866-8583  Please make sure to check & see if you have heat, electricity, hot water and the hot tub (if your cabin has a hot tub) is working upon check in.  Even though your cabin has been professionally inspected, working services upon arrival due to changes from mountain climate and conditions cannot be guaranteed.
All reservations made in advance either on our website as an online booking or made with our reservationist require a credit card to reserve the property.  If it is 30 days or more prior to your reservation you may send a check for your stay.  However, when the booking is made, a credit must be presented to hold that property.  No checks will be accepted 30 days or less prior to stay.  If you are 30 days or less prior to your stay or for a holiday booking, your credit card will be charged for the total amount including all taxes and fees at the time the reservation is made. If you make special arrangements (Non Holiday) to only pay 1/2 the amount when you make the reservation, the 2nd half is due 15 days prior unless the reservation is coming up soon or in the case of a Holiday full payment is required at booking.  Holiday reservations must be paid in full 30 days prior to arrival. Lessee/guest understands that once a credit card number has been given, Village Reservation Service has the right to charge said card for monies due on reservation. Reservation is confirmed at time of booking either online or on the phone. Village Reservation Service must receive all signed documents directly upon completion of reservation.  If that cannot be done immediately please contact the office at 909-866-8583 right away to discuss options. Village Reservation Service reserves the right to refuse service to anyone.

Security Deposit

The CSA Damage Protection Plan plan will be offered at booking.  It covers unintentional damages to the rental unit that may occur during your stay. The policy will pay a maximum benefit of [$1500.00]. Any damages that exceed [$1500.00] will be charged to the credit card on file. If, during your stay at one of our Rental Properties, an Insured Person causes any damage to real or personal property of the unit as a result of inadvertent acts or omissions, the Insurer will reimburse the Insured for the cost of repair or replacement of such property up to a maximum benefit of $1500.00. Certain terms and conditions apply. Full details of the Security Deposit Protection coverage are contained in the Certificate of Insurance or Insurance Policy. The Security Deposit Protection can be purchased up to, and including at, check-in. By submitting payment for this plan, you authorize and request CSA Travel Protection and Insurance Services to pay directly to Village Reservations any amount payable under the terms and conditions of the Security Deposit Protection. Please contact Village Reservations directly if you do not wish to participate in this plan or assignment.  The plan is an option.  If you elect to not purchase the protection plan a security deposit will be collected and will be a minimum equivalent of 1 nights stay, minimum of $300.00.  This must be in cash or check 30 days prior to your stay.  The security deposit is refundable within 21 days pending property inspection and will be charged if any excessive cleaning or trash removal is needed.  The security will also be charged for any damages or missing items that may include pay per view charges etc. incurred during your stay.
 Maximum Occupancy
The maximum occupancy a property will allow is strictly enforced by the City of Big Bear Lake and Village Reservation Service.  In your confirmation paperwork and on your notice agreement the occupancy for the property you rented is stated clearly and must be honored by you and your guests. If occupancy exceeds that of the maximum occupancy allowed for the property, you will be charged accordingly and/or will be immediately removed from the property with NO REFUND.  Please see the “Notice agreement”.

Cancellation Policy

A $75.00 charge or 10% of the reservation total, whichever is greatest, will be applied for all non-holiday cancellations made 2 or more weeks prior to arrival. For cancellations made less than 14 days prior to arrival and for all Holiday cancellations, the total sum (reservation total) will be forfeited unless we can re-book the night(s). There are no guarantees that property can be re-booked. Any Holiday reservation not fulfilled is grounds for forfeiture of all rental monies.

Credit Card Policy

At the time of booking whether online or on the phone you will be required to present a credit card for your reservation, deposits, etc.,  That card will be used to ensure your reservation and will be charged at time of booking.   As part of an on-going effort to ensure your security, the credit card used at booking must be presented at check-in by the cardholder, along with that persons current I.D. Village Reservation Service has the right to refuse service to anyone and/or cancel a reservation if the credit card and cardholder are not present at check-in.

The Rental is Privately Owned

The property you have rented is privately owned and Village Reservation Service reserves the right to refuse service to anyone. Most property owners require the booking adult to be 25 years of age or older. We are not and will not be held responsible for any loss or injury, by any means, of any kind, incurred on the premises. It is understood and agreed that Village Reservation Service/Accommodations Big Bear and/or their principals are acting as Agent of the Owner and not as principal and that Agent shall not be held liable to lessee or guest(s). Village Reservation Service/Accommodations Big Bear has no control over the mechanical operation of spas and/or Jacuzzis or Internet services. Spas/Jacuzzis are professionally serviced and cleaned on a weekly basis. NO COMPENSATION WILL BE CONSIDERED FOR INOPERABLE SPAS AND/OR JACUZZIS

No Pets – No Smoking

 A good number of properties are not pet friendly and none allow smoking. If you have declined the damage protection plan then a $200 pet deposit (refundable in most cases) is required. There is a $10.00 per pet, per night fee in addition to your deposit and is non-refundable, if pets (dogs) are allowed at the cabin. If you bring pets without our permission you will lose your entire security deposit of $200 and or incur extra charges.  If you have smoked or have allowed someone in your party to smoke inside the home you may lose your entire security deposit or be liable for additional charges.
CHECK IN AND CHECK OUT
Check-in time is 3:00 p.m. and check out time is 11:00 a.m. (check ins from 12/19 thru 1/2 are 4pm and check out is 10am.) unless other arrangements have been made.  Please call the morning of your arrival to see if an early check-in is possible.  NO early check-ins or late check-outs are possible during the winter holiday season from Dec. 19 thru Jan 2nd.  If a late check out has been pre-arranged, based on availability, extra charges will apply. Village Reservation Service inspects all properties the day of your arrival to ensure the home is ready for your stay. Early check-ins can dramatically affect our quality assurance program and our staff will make an effort to accommodate your request if possible, but is not guaranteed. If you are arriving after 5 pm you will need to go to All Protection Alarm (see your reservation paperwork for that info). Snow removal, finding the property and access to the property can be more difficult after hours.  Please plan accordingly.  No credits or refunds will be given to parties that arrive late and experience difficulties.

 Key Drop Off

Upon Check-out, KEYS MUST BE DROPPED OFF AT VILLAGE RESERVATION SERVICE AT 713 PINE KNOT AVENUE. There is a Key-Drop (bird house) right outside the front door if the office is closed. IF KEYS ARE NOT RECEIVED, A $50.00 fee or more will be charged to your credit card for a lock change.   DO NOT drop keys at All Protection Alarm for any reason. ALL PROTECTION ALARM HANDLES LATE CHECK-INS ONLY and will not accept keys at check out!

Must Comply with Ordinance Rules

Lessee understands that they must comply with ordinance rules and regulations set forth in the “Notice Agreement” and that any variation will result in immediate removal from the property with NO REFUND AND NO COMPENSATION. Lessee understands that any disturbance that results in any Law Official, Fire Official or Code Compliance Official going to the property may result in the immediate removal from the property with NO REFUND AND NO COMPENSATION.

Vacation Rental Agreement - Terms and Conditions
 
These Terms and Conditions, along with the confirmation email We send You after You make Your reservation (“Reservation Confirmation”), form a binding contract between You and Us, effective as of 24 hours after We send the Confirmation Email to You (“Agreement Date”).

In these Terms and Conditions, “Agreement” means these Terms and Conditions and the Confirmation Email collectively. “You” and “Your” means the person or persons making the reservation and those who will be staying at the Property as guests. “We,” “Our,” “Ours,” and “Us” means Big Bear Splash Inc. (DBA Village Reservations), a California corporation.

We manage the rental property located at the address identified in the Confirmation Email(“Property”). With this Agreement, You and We (collectively, “Parties”) wish to agree on the terms of Your renting the Property on a short-term basis for vacation purposes. Therefore, the Parties agree as follows:

1. Rejection of Agreement.
By making a reservation and payment on Our website, travel agent (airbnb, home away etc.) or any other means, You are agreeing to accept or reject this Agreement within 24 hours of Our sending You the Confirmation Email. To reject this Agreement, You must respond to the Confirmation Email at info@villagereservations.net and notify Us that You wish to reject this Agreement. If You do not reject this Agreement within 24 hours of Our sending the Confirmation Email, You will automatically be deemed to have accepted this Agreement.

2. Reservation.
Subject to the terms and conditions of this Agreement, You will rent the Property solely for short-term vacation purposes between the “Check-In Date” and “Check-Out Date”identified in the Confirmation Email. Your lease of the Property will start at 4:00 p.m. on the Check-In Date, and will end at 10:00 a.m. on the Check-Out Date. You may not check in early or check out late without Our prior agreement. However, We may require check in to occur later than 4:00 p.m. during peak holiday periods.

3. Rent and Other Charges.
You will pay Us the full amount of rent, taxes and other fees stated in the Confirmation Email (collectively, “Total”). Rent may be combined with other Fees and will be stated in the Confirmation Email.
(a) Payment Deadlines. If Your Agreement Date is less than 14 days before check-in (30 days for Holiday Reservations), You authorize Us to charge 100% of the Total Charges to Your credit card when You make the reservation. If Your Agreement Date is 14 days or more before (30 days for Holiday Reservations), Your check-in date, You authorize Us to charge 50% of the Total Charges to Your credit card when You make the reservation, and charge the remaining 50% to Your credit card 14 days before Your Check-In Date ("Second Charge Date")
(b) Authorization. You authorize Us to charge Your credit card on file without any further notice to You on the Second-Charge Date. If 100% of the Total Charges aren’t paid to Us by the Second-Charge Date, We may cancel Your reservation at any time.
(c) Nonrefundable Reservation Fees. “Nonrefundable Reservation Fees”may be combined with Rent and are included in the Total Charges. Nonrefundable Reservation Fees are travel-agent fees (airbnb, booking.com, home away marketing etc.) or Protection Fee as stated in the Confirmation Email as well as any other fees (if any) designated in the Confirmation Email. Nonrefundable Reservation Fees are fully earned by Us on the Agreement Date. Except as otherwise set forth in this Agreement or otherwise required by applicable law, We have no obligation to refund the Nonrefundable Reservation Fees to You for any reason, even if: (1) We cancel Your reservation because You failed to pay 100% of the Total Charges by the Second-Charge Date; or (2) You cancel Your reservation (even if You cancel before the Cancellation Deadline referred to below).
(d) Application of Payments. Payments You make to Us are first credited toward the Nonrefundable Reservation Fees (and related taxes), then the rental fees (and related taxes). You will pay Us $25 for any returned check.
(e)Protection Fee. If You purchase Booking Protection Coverage, We will honor a full refund of rental excluding "Nonrefundable Fees" mentioned above provided you cancel at least 7 days in advance of check in. No cancellation Fee will be charged.
 

4. Cancellations.
We do not
(a) You may cancel Your reservation with no cancellation fee by giving Us written notice at least 30 days (60 days for Holiday Reservations) before Your Check-In Date. If You do so, We will refund You the Total Charges except for the Nonrefundable Reservation Fees.
(b) You may cancel Your reservation with a Cancellation Fee by giving Us written notice at least between 30-14 days (60-30 days for Holiday Reservations) prior to Your Check-In Date. The Cancellation Fee is $125.00 or 10% of the reservation total. The remainder of the reservation total will be refunded to the card on file.
(c) If You cancel Your reservation after the Cancellation Deadlines above, We will have no obligation to refund You any amounts You paid, except for any Security Deposit, unless otherwise required by applicable law. You acknowledge and agree that cancellation Protection is available for You to purchase from us or there are types of Travel Insurance available from various third parties which may avoid or mitigate the risk of Your losing amounts You have paid under this Agreement if You cancel Your reservation.
(d) To the fullest extent permitted by applicable law: (1) We may cancel Your reservation at any time for any reason, in Our sole and absolute discretion, and if We do so, We will refund You the Total Charges, including the Nonrefundable Reservation Fees; (2) We may move up Your Check-Out Date for any reason in Our sole and absolute discretion, in which case We will refund You a proportionate percentage of the Total Charges, including the Nonrefundable Reservation Fees; and (3) We will not be liable to You for any damages if We cancel Your reservation or move up Your Check-Out Date.

5. Holdover.
If You fail to check out and give Us possession of the Property on time on the Check-Out Date, We may charge You daily rent for the time You holdover at a rate equal to the lesser of: (a) 200% of the amount of the daily rent set forth in the Confirmation Email; or (b) the maximum rate permitted by applicable law.

6. No Assignment or Subleases.
You may not assign any part of this Agreement, sublease any portion of the Property, or grant any license or right to use any part of the Property. Any attempted assignment, sublease, or grant without Our written consent will be void.
